ORDINANCE 2025-3 APPROVING CAP BANK FOR THE 2025 COUNTY BUDGET
WHEREAS, the Local Government Cap Law, NJSA 40A: 4-45.1 et seq., provides that a county shall limit any increase in the county tax levy to the lessor of 2.5% or the prior year’s cost of living index (2.5% for 2025) unless authorized by ordinance to increase said Cap rate up to 3.5% over the previous year’s final county tax levy, subject to certain exceptions; and
WHEREAS, the Division of Local Government Services through a directive contained within Local Finance Notice 2024-15 allows for retaining “banking” any excess of the cap calculation over the tax levy; and
WHEREAS, the Board of County Commissioners of the County of Cumberland will introduce the 2025 budget below the 2.5% tax levy cap limitation.
NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners of the County of Cumberland, that the 2.5% calculation authorized pursuant to the Local Government Cap Law that is not raised as part of the 2025 county tax levy shall be retained and “banked” as an exception to the county tax levy in either of the next two succeeding years (2026 and 2027); and,
BE IT FURTHER ORDAINED that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction and a certified copy of this ordinance be filed with said Director within 5 days after adoption.
STATEMENT
The Ordinance, the summary terms of which are included herein, was introduced and passed upon first reading at a meeting of the governing body of the County of Cumberland, State of New Jersey, on May 27, 2025. It will be further considered for final passage , after a public hearing thereon, at a meeting of the Board of County Commissioners to be held at the Cumberland County Administration Building, 164 West Broad Street, Bridgeton, New Jersey 08302 on June 24, 2025 at 6 o’clock p.m. prevailing time at which time and place comments and objections to the Ordinance 2025-3 may be presented by members of the public.
During the week prior to and up to and including the date of such meeting, copies of the full ordinance will be available at no cost during regular business hours at the Clerk of the Board’s office for the members of the general public who shall request the same.
